Travis C. Jackson is the founder and principal attorney of Jackson Legal, LLC, a Cape Cod law firm based in Osterville, Massachusetts.
Attorney Jackson focuses his practice on probate, estate administration, complex probate and trust matters, fiduciary disputes, probate avoidance estate planning, estate related real estate transactions, landlord side evictions, and select small business matters.
Over the past decade, he has represented individuals, families, fiduciaries, heirs, beneficiaries, property owners, landlords, and small business clients in Massachusetts Probate and Family Court, Superior Court, Housing Court, District Court, the Massachusetts Appeals Court, and federal court.
Much of his practice involves helping clients solve legal problems that are not simple or routine. These matters often involve family conflict, disputed fiduciary authority, missing or unclear documents, contested inheritance rights, trust questions, real estate complications, title issues, creditor pressure, business disruption, or court intervention.
Attorney Jackson is often called upon when a matter has become complicated, stalled, urgent, or difficult to untangle. His work is focused on identifying the practical issue, determining the appropriate legal path, and moving the matter toward resolution.
Attorney Jackson’s core practice is probate and estate-related work.
He assists clients with estate administration, formal and informal probate proceedings, fiduciary appointments, contested probate matters, trust questions, disputed accounts, fiduciary conduct, surviving spouse rights, heirship issues, estate real estate, and probate-related title problems.
Many of these matters involve real estate, family disputes, unclear authority, or multiple parties with competing interests. His experience allows him to approach probate matters not simply as paperwork, but as practical problems involving people, property, money, court process, and risk.
Attorney Jackson also prepares probate avoidance estate plans, with a focus on revocable living trust packages for clients with Massachusetts real estate.
His estate planning work is informed by his probate practice and by his experience seeing what can go wrong when estate plans are incomplete, unclear, outdated, or not properly coordinated with real estate ownership.
A typical revocable trust plan may include a revocable living trust, pour over will, durable power of attorney, health care proxy, HIPAA authorization, certificate of trust, and deed transferring Massachusetts real estate into trust.
In addition to probate and estate matters, Attorney Jackson represents small-business owners, landlords, property owners, and entities in select matters involving business formation, contracts, operating agreements, creditor issues, business property, fraud, franchise issues, construction-related disputes, collections, and litigation.
His small-business work often involves situations where the business is under pressure and needs practical legal strategy to protect property, preserve operations, respond to creditor claims, or resolve a dispute.
He also represents landlords, business entities, property owners, and personal representatives in summary process and property possession matters.
Attorney Jackson has handled a wide range of matters involving complex probate, trust, estate, real estate, landlord, business, and civil litigation issues. Representative matters include:
Complex Probate / Title Resolution
Handled a sophisticated Cape Cod title and probate matter involving approximately a dozen related estates, numerous probate proceedings required to establish authority and clear title, and nearly 35 heirs, resulting in the successful sale of real estate valued at approximately $1.5 million and distribution of proceeds.
Heirship / Foreclosure Avoidance
Probated the estate of a reclusive decedent, located lawful heirs in other states, avoided foreclosure of multi-million-dollar real estate after years of unpaid property taxes, and helped secure a substantial inheritance for heirs who initially did not know they had rights to the estate.
Intestate Heirship / Genealogy Dispute
Successfully objected to the probate of a high-value intestate estate by a group of second cousins, used expert genealogical evidence to establish that four cousins once removed were the lawful heirs, and secured a substantial inheritance for those heirs.
Fiduciary Dispute / Incapacitated Beneficiary
Represented the interests of an incapacitated beneficiary in a contested estate matter involving millions of dollars in real property that had remained under the control of the personal representative for years, successfully forcing the sale of the real estate and securing distribution of funds to the beneficiary’s out-of-state guardian/conservator.
Fiduciary Fee Dispute / Contested Estate Accounting
Represented a beneficiary in objecting to a personal representative’s six-figure fiduciary fee and disputed reimbursements from a simple estate, successfully recovering funds and nearly tripling the client’s inheritance distribution.
Trust Interpretation / Inheritance Litigation
Successfully litigated the interpretation of a trust intestacy clause and substantially increased a client’s inheritance by applying Massachusetts adoption law.
Trust Invalidation / Estate Real Estate
Successfully challenged the validity of a trust in Probate Court, resulting in multi-million-dollar real estate assets becoming part of multiple connected estates.
Surviving Spouse / Elective Share Dispute
Represented a surviving husband in a contested probate matter after he had been excluded from his wife’s estate plan, recovering funds removed from a joint marital account and subsequently invoking his statutory right to waive the will and claim an elective spousal share.
Appeals / Testamentary Capacity
Handled an appeal before the Massachusetts Appeals Court in a matter involving a will that had been invalidated based on lack of testamentary capacity.
Emergency Fiduciary Removal / Estate Recovery
Represented an out-of-state heir after the decedent’s sibling filed a voluntary administration statement claiming to be the decedent’s only child and heir. Successfully obtained emergency relief removing the sibling from control of the estate, secured proper estate administration, and facilitated the sale of remaining property to help offset losses caused by improper conduct.
Elder Protective Proceeding / Power of Attorney Dispute
Represented the close friend and nominated attorney-in-fact of an elderly man with no immediate family after a bank questioned the validity of the power of attorney and a protective proceeding was filed seeking conservatorship. Worked with elder services to address concerns, demonstrate the client’s longstanding care and support, resolve the matter by agreement, and help ensure the elder remained safely and comfortably at home during his remaining years.
Life Insurance / Probate / Minor Children
Represented a former spouse in a complex probate and life insurance dispute involving multiple minor children, divorce-related beneficiary issues, and approximately $1 million in disputed life insurance proceeds. Successfully navigated formal probate and fiduciary appointment issues, negotiated the client’s appointment as personal representative, and helped secure the proceeds in trust for the benefit and support of the children.
Will Contest / Charitable Beneficiary Dispute
Represented family members in a contested estate involving a multi-million-dollar estate plan that left assets to nonprofit beneficiaries shortly before death. Despite medical records supporting testamentary capacity, negotiated a six-figure will compromise, secured payable-on-death bank benefits, and obtained payment of legal and fiduciary fees.
Estate / Foreclosure Litigation
Represented an estate in Superior Court litigation involving the foreclosure of two Cape Cod properties valued at more than $1.5 million and resolved the matter shortly before trial through a significant negotiated buyout.
Emergency Foreclosure / Small Business Property
Represented a small-business owner whose business property was scheduled for foreclosure by a non-traditional lender the following day, filed an emergency motion challenging lender documentation issues, and stopped the foreclosure approximately 17 hours before the auction.
Landlord Side Evictions / Summary Process
Represented hundreds of landlords, business entities, property owners, and personal representatives in summary process matters, securing possession of residential and commercial properties through Housing Court and District Court proceedings.
Federal Court / Small Business Franchise Dispute
Represented a local small business in federal court in a dispute involving a franchise agreement that threatened the continued operation of the business and negotiated a resolution and termination of the franchise agreement that allowed the business to continue operating.
Federal Court / Unfair and Deceptive Business Practices
Represented an elderly client in federal court litigation against a national bank involving claims of unfair and deceptive business practices, resolving the matter through a favorable six-figure settlement.
Business Distress / Construction Dispute
Represented a multi-million-dollar small business builder/contractor in a high-stakes dispute arising from a luxury home construction contract issue, defending against and resolving claims from numerous creditors seeking over seven figures while helping the business continue operating.
Small Business / SBA Loan Fraud / Creditor Litigation
Represented a small business and its owner in multiple Superior Court matters arising from a sophisticated fraudulent loan scheme involving numerous SBA loans allegedly taken out in the name of the owner and business. Used handwriting expert analysis and documentary evidence to establish fraud, stopped creditor litigation by national banks, secured judgment against the fraudulent actor, and helped the business continue operating without asset freezes or disruption.
